Terms of Service

1. Acceptance of Terms

By creating an account, downloading, or using VibsZ ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and VibsZ Inc.

2. Eligibility

You must meet the following requirements to use VibsZ:

• Be at least 18 years of age
• Be legally able to enter into a binding contract
• Not be prohibited from using the Service under applicable law
• Not have been previously banned from VibsZ for violating these Terms or our Community Guidelines

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information up to date
• Not share your account with others or create multiple accounts
• Notify us immediately of any unauthorised access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Community Guidelines

VibsZ is designed for authentic, respectful, real-world connection. You agree not to:

• Harass, bully, intimidate, or threaten other users
• Post content that is hateful, discriminatory, sexually explicit, or violent
• Impersonate another person or misrepresent your identity
• Use VibsZ for commercial solicitation, spam, or advertising without permission
• Stalk, follow, or monitor other users in real life without their consent
• Attempt to extract personal information from other users for malicious purposes
• Use automated bots, scripts, or tools to access the Service
• Interfere with the security or proper functioning of the platform

Violations of our Community Guidelines may result in content removal, account suspension, or permanent ban at our sole discretion.

5. Content and Intellectual Property

Your Content

You retain ownership of content you create and share on VibsZ. By posting content, you grant VibsZ a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your content solely for operating and improving the Service.

Our Content

VibsZ and its logos, visual design, user interface, software, and documentation are owned by VibsZ Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our Service without written permission.

6. Safety and Real-World Interaction

VibsZ facilitates connections between nearby people. While we implement safety features (verification, reporting, blocking, ghost mode), we cannot guarantee the behaviour of other users. You acknowledge that:

• You interact with other users at your own risk
• VibsZ is not responsible for the actions of any user during in-person meetings
• You should exercise caution, meet in public places, and inform others of your plans
• You should report any concerning behaviour to both VibsZ and local authorities

7. Location Services

VibsZ requires access to your device location to function. By enabling location services, you consent to VibsZ using your location data as described in our Privacy Policy. You can disable location sharing at any time, though this will limit the functionality of the Service.

8. Subscriptions and Payments

VibsZ is free to download and use. We may offer optional premium features through in-app purchases or subscriptions. If you purchase a subscription:

• Payment will be charged to your app store account at confirmation of purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
• You can manage or cancel subscriptions in your device settings
• Refunds are handled according to the policies of the applicable app store (Apple App Store, Google Play)

9. Termination

You may delete your account at any time through the app. We may suspend or terminate your access if you violate these Terms, our Community Guidelines, or applicable law. Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination (intellectual property, limitation of liability, dispute resolution) will remain in effect.

10. Disclaimers

VibsZ is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We disclaim all liability for any content posted by users or any interactions between users.

11. Limitation of Liability

To the maximum extent permitted by law, VibsZ Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

12. Dispute Resolution

Any disputes arising from these Terms or your use of VibsZ shall first be attempted to be resolved through amicable negotiation within 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Lucknow, Uttar Pradesh, India. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, and proceedings shall be in English.

13. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated through the app or via email at least 14 days in advance. Your continued use of VibsZ after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Indian Contract Act, 1872, and all rules and regulations made thereunder. The courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising from these Terms.

15. Intermediary Status

VibsZ operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including appointment of a Grievance Officer, Nodal Contact Person, and Chief Compliance Officer as applicable.
